Intellectual Property: All designs, photos, and branding for Likalu Pottery are the property of Likalu Pottery and cannot be used without permission.
Limitation of Liability: Likalu Pottery shall not be held liable for any direct, indirect, or incidental damages resulting from the use or misuse of our handmade products, including but not limited to injuries caused by breakage, thermal shock, or improper handling once the item has been delivered.
Governing Law
These terms and any disputes arising from the use of our products or website shall be governed by and construed in accordance with the laws of the State of Oregon, and any legal proceedings shall take place exclusively in the courts of Josephine County, Oregon
Nature of Handmade Ceramics
At Likalu Pottery, every piece is handcrafted and unique. By purchasing my work, you acknowledge:
5. Artisanal Variations: Slight variations in color, texture, and dimensions are inherent to the handmade process and are not considered defects.
Unique Characteristics: No two pieces are exactly alike, and the item you receive may vary slightly from website photography.
2. Product Liability Disclaimer
While I strive to create high-quality, durable functional ware, ceramics are inherently fragile. By purchasing or using Likalu Pottery products, you agree to the following:
Assumption of Risk: You acknowledge that ceramic items can break, chip, or shatter under normal use, accidental impact, or thermal shock. Broken ceramics can create sharp edges or fragments that pose a risk of injury.
Proper Use and Inspection: It is the customer's responsibility to inspect items for cracks or chips before each use. Discontinue use immediately if any damage is found.
Limitation of Liability: To the maximum extent permitted by law, Likalu Pottery is not liable for any personal injury, property damage (including leaks or spills), or losses arising from the use or breakage of our products.
Maximum Remedy: In any event of a proven product failure, Likalu Pottery’s maximum liability is limited strictly to the refund of the original purchase price of the item.
3. Care and Safety Compliance
Safe use is required to maintain the integrity of your pottery. Likalu Pottery is not responsible for damage resulting from:
Improper Handling: Dropping, striking, or mishandling the piece.
Thermal Shock: Subjecting the piece to extreme, sudden temperature changes (e.g., refrigerator to hot oven).
Unauthorized Use: Use for any purpose other than the item's intended functional or decorative design.
4. Returns and Damages
Damaged on Arrival: Please notify me at likalupottery@gmail.com within 5 days of receipt if an item arrives broken, including photos of the packaging and product.
Final Sale: Due to the small-batch nature of my work, Likalu pottery and many other potters do not offer returns on custom or made-to-order pieces unless they arrive damaged
